Privacy Policy

Pernickety Recruitment Pty Ltd respects the privacy rights of all individuals with which the Company interacts whilst conducting business. Pernickety Recruitment is bound by the 10 National Privacy Principles (NPP) set out in the Privacy Act 1988. The NPP stipulate the handling requirements of personal information. Personal information is defined as: "Information (or an opinion) about an individual whose identity is apparent, or can be reasonably ascertained, from the information or opinion." Below are the NPP and how they relate to Pernickety Recruitment;

1. Collection of Information

Pernickety Recruitment will not collect personal information unless the information is necessary for one or more of its business functions, this information will be collected only by lawful and fair means and not in an unreasonably intrusive way.

If an individual decides not to provide Pernickety Recruitment with the information requested, Pernickety Recruitment may not be able to process their applications for employment.

 

2. Use and Disclosure of Information

Pernickety Recruitment will only use or disclose information for the purpose it was collected, unless the person has consented, or for a secondary purpose which is related to the primary purpose (of collection) and a person would reasonably expect such use or disclosure, or in circumstances related to the public interest such as law enforcement and public or individual health and safety. Pernickety Recruitment may disclose information it holds about individuals to third parties. For example:

  • Potential employers;
  • Auditors;
  • Banks;
  • Legal and professional advisers;
  • Superannuation providers;
  • Insurance providers, including workers compensation bodies;
  • Government regulatory bodies such as the Australian Taxation Office;
  • Your referees and former employer
  • Your consent to the above disclosures is taken to have been given when you submit your personal information to Pernickety Recruitment.

3. Data Quality

Pernickety Recruitment will take reasonable steps to make sure that the personal information it collects uses or discloses is accurate, complete and up-to date.

If at any time you feel that your personal information held by Pernickety Recruitment is inaccurate, please contact us to provide the corrected and/or updated information.

4. Data Security

Pernickety Recruitment will take reasonable steps to protect the personal information it holds from misuse and loss and from unauthorised access, modification or disclosure. Such reasonable steps include:

  • Restricted building access where information is kept.
  • Locked Cabinets which contain personal information
  • Network security (Firewalls) and individual passwords for applications which contain personal information

Pernickety Recruitment will retain information for a period of time as required by relevant legislation, once the information is no longer required Pernickety Recruitment will take reasonable steps to destroy and permanently de-identify the information.

Although Pernickety Recruitment will take all reasonable steps to keep secure any information that it holds about you, Pernickety Recruitment will not be held responsible for events arising from unauthorised access to such information.

5. Openness

Pernickety Recruitment will maintain a document detailing its Procedure for handling private information, this is available to anyone who asks, for further details about specific procedures please contact Pernickety Recruitment's Privacy as noted at the end of this document.

6. Access and Correction

In most cases, Pernickety Recruitment will give an individual access to personal information it holds about that individual (including information collected directly or indirectly from the individual and information collected from third parties) on request.

Pernickety Recruitment may withhold information where it feels a request:

  • Provides an unreasonable impact on the privacy of other individuals;
  • Is frivolous or vexatious;
  • Provides a threat to the life or health of any individual;
  • Providing access would be likely to prejudice an investigation of possible unlawful activity
  • Would reveal our intentions in relation to negotiations with you, in such a way that it would prejudice those negotiations;
  • Requires access that is unlawful, or denying access is required by law
  • Information relating to an existing or anticipated legal proceedings between the Pernickety Recruitment and an individual

    An administration charge of $20.00 will apply when providing access to information. You will be asked to pay any charges that apply at the time of making the request. You will not be charged for merely lodging a request.

7. Identifiers within Information

Pernickety Recruitment will not use any personal identifiers issued by a government agency (for example a tax file number, Medicare number) as a personal identifier. For example, Pernickety Recruitment may require an individual to provide their tax file number, but will only use that number for the purposes permitted by legislation and not as a general means of identification.

8. Anonymity

Wherever it is lawful and practicable, individuals will be given the option of not identifying themselves when entering transactions with Pernickety Recruitment.

9. Trans-border Data flows

Pernickety Recruitment will not transfer information to another party in another country without the consent of the individual.

10. Sensitive Information

Personal information may include sensitive information, which may include such information as membership of a professional or trade association or trade union, your health (including any disability), your racial or ethnic origin or any criminal record you may have. Where Pernickety Recruitment collects this type of information your consent will be obtained.
